CubeSMS Terms & Conditions
It is a condition of purchasing SMS credits through that the purchaser acknowledges and agrees to comply with the following Terms and Conditions, and the user's use of the service constitutes acceptance of these Terms and Conditions.
CubeSMS may alter these Terms and Conditions from time to time without notice and it is the user's responsibility to monitor amended Terms and Conditions. All changes are effective from the date of posting on the CubeSMS website. Any updated version of the Terms and Conditions will immediately supersede any prior version.
All credits purchased through CubeSMS can only be used with CubeSMS and are not transferable or refundable. All SMS credits expire after 18 months.
Unless otherwise agreed to in writing credits are issued to users accounts upon funds being cleared; Credit Card is generally immediate while other means of payment can take up to 3 business working days.
CubeSMS shall not be responsible for any incorrect or inaccurate information, whether caused by SMS users, or by any of the equipment or programming associated with or utilized with the SMS Updates application, or for any technical or human error which may occur in the course of the operation or administration thereof.
These Terms and Conditions will be governed by and construed in accordance with the laws of Tasmania, Australia, and the user agrees to submit to the exclusive jurisdiction of the courts of the State of Tasmania. In the event that any provision of these Terms and Conditions is held to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Terms and Conditions which shall continue to have full force and effect.
SMS is not a guaranteed delivery communication tool. CubeSMS cannot accept responsibility for any SMS messages not received by the user, or for any delay in the receipt or delivery of the SMS message. CubeSMS assumes no responsibility for any user error or omission, interruption, deletion, defect, delay in operation or transmission, communications line/network failure, computer viruses, bugs, unauthorized intervention, fraud, technical failures, theft or destruction or unauthorized access to, or alteration of, any information provided by an SMS user.
All live information is subject to cancellations and changes. While we do our best to provide and ensure up to date information on services operated we take no responsibility for cancellations/delays/other incidents, which may occur.
Any individual with any query or concern in relation to the use of CubeSMS solutions can direct those concerns to CubeSMS 1300 778 060. We will endeavour to address and resolve these with said individual within 5 working days.
CubeSMS will take all appropriate steps to ensure safety of your mobile phone details and will not sell these on to any third-party. By subscribing to being a user of CubeSMS's services you are agreeing to receive occasional SMS messages from CubeSMS informing you of promotions and events. You will not be charged for receiving these messages.
